This is an appeal from a judgment of the district court of Kiowa county sustaining a demurrer to an amended petition and dismissing the action. The parties will be referred to as they appeared in the trial court.

From the allegations of the amended petition, it appears that the plaintiff, while, in the employ of the defendant and while engaged in the performance of manual labor within the provisions of the Workmen’s Compensation Act, sustained an accidental personal Injury which arose out of and in the course of the employment.
