In 1855, the plaintiff was the owner in fee of the lands described in the complaint, and then executed to the defendant a mortgage upon the lands, which is also described in the complaint. In April, 1865, the plaintiff had; become insolvent, and the mortgage remained unpaid, and he was unable to pay it. At that time, the plaintiff claims a>. paroi agreement was made as to the foreclosure of the mortgage, which he seeks to enforce in this action.
