CAMPBELL, District Judge.

The above-entitled action comes before this court on a motion made by the defendant tp dismiss the complaint therein, on the ground that the same does not state facts sufficient to constitute a cause of action.

The complaint in the above-entitled action contains the following allegations:

That the plaintiff is a resident of the city and state of New York. That the defendant, Warren G. Price, at all the times mentioned was and is the collector of the United States internal revenue for the First district of New York, and a resident and inhabitant of the Eastern district…
