Defendant Will Fox appeals from a judgment against him on a promissory note for $1,160. He defended in the action on the ground that the note had been obtained from him by alleged fraudulent representations on the part of E. C. Wingen, the cashier of plaintiff bank. The action was against Fox, hereinafter referred to as defendant, and one George Hannay. Hannay did not answer or defend. The jury returned a verdict in favor of defendant Fox. Thereafter, on motion of the plaintiff, the court ordered judgment against the defendant notwithstanding the verdict, and the appeal…
