This is the second time this ease has been before this court. The opinion on the former appeal is reported in 185 S. W. 615. The suit was originally instituted by the appellee, • Mrs. Ellen MacKechnie, as guardian of the person and estate of Edward MacKechnie, against the appellant, Western Indemnity Company, a corporation organized under the laws of the state of Texas, and the Western Casualty & Guaranty Insurance Company, a corporation created under the laws of the state of Oklahoma, on an accident insurance policy.
