The appeal is from the district court of McIntosh county. The cause had its origin in the county court of McIntosh county. -This is the second time this court has been called upon to determine the tights of contending parties in the property of one Adam Scott, deceased, a citizen by blood of the Creek Nation. Upon the death of Adam Scott, a petition was filed in the county court of McIntosh county to determine heirship. .
