MEMORANDUM OPINION AND ORDER
HOLWELL, District Judge.
Plaintiff Alvin Peterson brings suit under 42 U.S.C. § 1983 against former Assistant District Attorney Alan Tomaselli (“Tomaselli”), the City of New York, the Commissioner of the New York City Department of Corrections (“Commissioner”), and other unnamed defendants (collectively “defendants”).
