This case came before the Supreme Court on March 8, 2001, pursuant to an order directing both parties to appear and show cause why the issues raised in this appeal should not be summarily decided. The plaintiff, Elizabeth Ferguson (plaintiff or Ferguson), has appealed the grant of summary judgment entered in favor of the defendant, Wayland Manor Associates and Capstone Financial Services, Inc. d/b/a Capstone Properties (defendants or Capstone).
