GIBBONS, Circuit Judge.
This case is before us on remand from the Supreme Court, — U.S. —, 101 S.Ct. 2038, 68 L.Ed.2d 343, which on May 4, 1981 granted certiorari to review our decision in Griffith v. Wheeling-Pittsburgh Steel Corp., 610 F.2d 116 (3d Cir. 1979), vacated our judgment, and remanded for further consideration in light of its decision in Scindia Steam Navigation Co. v. De Los Santos, 451 U.S. —, 101 S.Ct. 1614, 68 L.Ed.2d 1 (1981). The parties were requested to file supplemental briefs addressed to the effect of the Scindia case on our judgment. Having…
