The third-party defendant Rita Litvak appeals an order of the United States District Court for the District of Connecticut denying her motion for relief from judgment under Fed.R.Civ.P. 60(b)(1), (4). Litvak argues that the district court’s order granting the defendant’s motion to dismiss was void because the ninety-day time limit for substitution imposed by Rule 25(a) had not yet passed at the time the order was entered.
