On July 18, 1945, this court rendered an opinion reversing, in part, the judgments of the courts below. The majority of the court as now constituted are convinced that that action was erroneous. Accordingly, the original opinion is withdrawn and the following is substituted therefor.

This is a suit by Lower Colorado River Authority, herein designated as LCRA, against Chemical Bank & Trust Company, herein called Trustee, The American National Bank of Austin, herein referred to as Co-Trustee, and the Attorney General of , Texas, seeking a declaratory judgment to determine the validity of Art.…
