Appeal by the plaintiff, Margaret Lang, from a judgment of the Supreme Court in favor of the defendants John C. Lutz and another, entered in the office of the clerk of the county of Erie on the 21st day of November, 1902, upon the decision of the court, rendered after a trial at the Erie Special Term, sustaining said defendants’ demurrer to the plaintiff’s complaint.

This action, which was commenced on the 22d day of March, 1902, was brought by the plaintiff as a creditor of a corporation known as the Bed Cross Drug Company, upon a note held by her which became due and payable on the 31st day of November, 1900, the amount due thereon at that date being the sum of $415.
The complaint, after setting forth the execution and delivery of the note in question, its maturity, the failure of the corporation to pay the same, and the amount due thereon, alleges that each of the defendants up to the 4th day of March, 1902, was the owner and holder of…
