Before the Court is the Government's Motion for Notification of an Advice of Counsel Defense. [Doc. 134]. For the reasons stated more fully herein, the Government's motion will be DENIED .

I. BACKGROUND

In this criminal action, the Government alleges that Defendants conspired and aided and abetted each other in committing health care fraud ( 18 U.S.C. § 1347 ); committing wire and mail fraud ( 18 U.S.C. §§ 1341, 1343 ); paying or receiving "illegal remunerations" (also colloquially known as "kickbacks" or "bribes") ( 42 U.S.C. § 1320a-7b(b)(2)…
