Plaintiff in error sued the defendant in error to recover the sum of $1,-000, the amount of a check drawn by him upon the Farmers’ State Bank & Trust Company of Gorman, Tex., and deposited with defendant in error, the petition alleging that the plaintiff in error received its deposit slip for said amount and the same was credited to him, and that afterward the defendant bank, in clearing with the state bank, collected the same either in cash or exchange from said Farmers’ State Bank & Trust Company, and thereupon became liable to plaintiff in error in the amount of said deposit, for which he…
