The defendant, George Francis, and Hilmar Larson, were indicted in the circuit court of St. Clair county for burglary and larceny. Upon the conclusion of the testimony the trial judge instructed the jury to find Larson not guilty. The jury found the defendant guilty as charged and fixed the value of the property stolen at $100. His motion fbr a new trial was denied and he was sentenced to imprisonment in the penitentiary. He prosecutes this writ of error for a review of the record.
