Paul Sampson (hereafter referred to as defendant) is a married man twenty-five years of age, residing in Mattoon, Illinois, and was indicted at the September term, 1928, of the circuit court of Moultrie county. The indictment consisted of four counts, the first, third and fourth of which were quashed. The second count charged defendant with burglarizing the chicken house of Harry McClure, in Moultrie county, with the intent to steal the goods, chattels and property of McClure.
