On January 30, 1939, the defendant, William T. Denning, was indicted in the circuit court of Coles county for maliciously burning broomcorn and other personal property of John L. Denning & Company, Inc., with the intent of defrauding the St. Paul Fire and Marine Insurance Company, the insurance carrier. He was arraigned on February 2, and moved to quash the indictment. Thereafter, on March 30, the defendant obtained leave to withdraw the motion to quash and pleaded guilty.
