The above-styled case involves a real estate venture gone bad. Pursuant to Rule 56, Fed.R.Civ.P., plaintiff Acrotube, Inc. (“Acrotube”) seeks partial summary judgment against defendant J.K. Florida Development, Inc. (“J.K. Florida”). Defendants J.K. Financial Group, Inc., J.K. Financial Corporation, and John E. Kearney (“Kear-ney”) (referred to collectively as “the other defendants”) have moved to dismiss for lack of personal jurisdiction under Rule 12(b)(2), Fed.R.Civ.P., or, in the alternative, to transfer the action under 28 U.S.C. § 1404(a).
