OPINION

ANDERSON, Justice.

A Goodhue County Grand Jury indicted William J. Auehampaeh, Jr. on ten counts, including three counts of first-degree mur*811der, for the stabbing death of his former girlfriend, Daillene Counts. A jury convicted Auehampach on all counts except for first-degree murder while committing criminal sexual conduct. The jury did not convict Auehampach of the lesser-included offense of first-degree manslaughter.
