Miller, Judge:

In an action of assumpsit upon an original and ah amended declaration, with general and special counts, and with bill of particulars attached, and upon issue joined upon defendants’ general plea of non assumpsit, and specification of set-off; or counterclaim, the plaintiff, on November 14, 1925, obtained a verdict and judgment against the defendants for $122,500.00, with interest and costs.

The cause of action as pleaded arose out of a contract, dated April 18, 1922, between plaintiff and defendants, relating to about 49,836 acres of land in fee and mineral and timber rights,…
