This is a controversy concerning a right of way. Appellee is engaged in the distribution and sale of natural gas for heating purposes in the city of Logansport, and owns a pipe-line extending to Logansport from the gas fields near the city of Kokomo. Appellant is the owner of a farm, described in the complaint, lying along the east side of and near to appellee’s pipe-line. Appellee had a contract with a company known as the Indiana Piping and Construction Company to put in appellee’s, plant.
