KELLEHER, Justice.
This is the plaintiff’s appeal from the grant by a Superior Court justice of the defendant’s motion to dismiss pursuant to Rule 12(b)(6) of the Superior Court Rules of Civil Procedure because of the plaintiff’s failure to state a claim upon which relief may be granted. The plaintiff, Tangler-idge Development Corp., filed a complaint for specific performance or, in the alternative, damages, alleging that the defendant, Theodore B.
