Affirming on the original appeal; on the cross appeal the judgment is reversed, with directions to enter a judgment dismissing Lykins’ petition with cost.

R. F. Lykins brought this suit against W. H. Ham-rick and John Hamrick, alleging in his petition that W. H. Hamrick on June 20, 1908, -assaulted him and cut him with a sharp knife near to his heart, inflicting painful injuries to his damage in the sum of $10,000, and that John Hamrick was present aiding and abetting W.
