This suit was by the state of Texas against the Grayburg Oil Company to recover the sum of $12,014, besides interest and penalty, claimed by the state as the unpaid balance of occupation tax of one cent per gallon on gasoline sold at wholesale by the oil company in the state of Texas, between June, 1923, and December, 1924, under chapter 5, Acts of the Third Called Session of the 38th Legislature (Vernon’s Ann.
