This is a proceeding under article 78 of the Civil Practice Act, wherein petitioner seeks an order in the nature of mandamus, requiring the respondents, clerks of the County of Kings and of the County Court of Kings County, respectively, to print a record on appeal from defendant’s (petitioner’s) conviction of the crime of murder in the first degree, and, more particularly, to include in said printed record, certain newspaper and magazine articles which were offered hut not received in evidence, being however, marked for identification.
