Tie defendant moves to dismiss tie appeal because tie assignment of errors does not set out tie exceptions and group them, but simply refers to tie exceptions themselves.
Tie first assignment of error is: “Tie court erred in allowing tie motion of tie defendant to strike out certain portions of tie complaint, as set forth in tie first exception.”
The second assignment of error is: “Tie refusal of tie court to admit certain testimony, as set forth in tie second exception.” Tie assignments of error 3, 4, 5, and 6 are of like tenor.
