This action was brought by the plaintiff in error in the district court of Seward county, to recover the possession of lot 1, in block 44, in the city of Springfield. The plaintiff in error claimed to be the equitable owner of the premises, which were a part of the Springfield town-site, which was located and laid out on the public lands of the United States, some time prior to the 9th day of November, 1885.
