In the information in this case, filed in the district court of Coal county, Howard Welborn was. charged with the crime of murder, alleged to have been committed in said county on or about the 7th day of June, lOSS, by then and there unlawfully, and feloniously, without authority of law and with a premeditated design to take the life of Stella Thomas, by shooting said Stella Thomas with a 38-caliber Colt pistol, thereby inflicting upon the body of the said Stella Thomas, certain mortal wounds, of which mortal wounds so inflicted she, the said.
