(after stating the facts as above) . This appeal is from a judgment of conviction for manslaughter in the first degree, the punishment having been assessed at imprisonment in the penitentiary for a term of four years. The information charged the defendant, Herbert Irby, of having committed the crime of murder by killing his wife, Ruby Irby, by shooting her with a pistol. The theory of the prosecution appears to have been that the killing was an assassination.
