This case presents a question as to the standard of proof required to find a vertical price-fixing conspiracy in violation of § 1 of the Sherman Act.

Petitioner Monsanto Co. manufactures chemical products, including agricultural herbicides. By the late 1960’s, the *756time at issue in this case, its sales accounted for approximately 15% of the corn herbicide market and 3% of the soybean herbicide market.
