Affirming.

The appellant, Louisville Gas & Electric Co., instituted this action against the appellee, Longley & Co., seeking to recover damages for injury to its gas pipes and mains, alleged caused "by the construction of sewers in certain streets of Louisville, Ky., by the appellee.

The jury returned a verdict for the appellee, and, from the judgment thereon, appellant prosecutes this appeal, relying for its reversal upon the following alleged errors of the trial court: (1) Error in giving a peremptory instruction to find for the defendant on the first…
