BACKGROUND

This case presents the issue of the preemptive effect of ERISA on several state claims brought in connection with a stop-loss type employee benefit plan. The suit arises out of Prudential Insurance Co.’s alleged mishandling of the claims of an employee of Sherwood Enterprises.
