Jackson, J.:

Appellant, Carl D. Tucker, appeals the denial of relief requested pursuant to K.S.A. 60-1507. On February 8, 1983, appellant was convicted of aggravated battéry. On February 25, 1983, sentence was imposed by the trial court. The journal entry of judgment concerning the sentencing reads as follows:

“IT IS THE SENTENCE OF THIS COURT AND IT IS HEREBY CONSIDERED, ORDERED, ADJUDGED AND DECREED that the defendant is hereby committed to the custody of the Secretary of Corrections for imprisonment for a period of not less than three (3) nor more than ten (10) years on the charge of…
