I.INTRODUCTION

Presently before the Court in this diversity action are Cross-Motions for Summary Judgment filed by the parties. (D.I. 32, 37, 38). The Plaintiff, Joseph Connell brought the present action against two Delaware insurance companies, Liberty Mutual Insurance Company (“Liberty Mutual”) and West American Insurance Company (‘West American”), seeking damages arising out of a 1989 automobile accident that occurred in Media, Pennsylvania.
