This matter comes before the Court on a motion for partial summary judgment by plaintiff Arthur J. Maurello (“Maurello”) against defendant United States of America (the “United States”), and a cross-motion for summary judgment by the United States against Maurello, both pursuant to Federal Rule of Civil Procedure 56.
