The sole question in this case is whether the district court properly dismissed plaintiffs’ suit against the City of Chicago (“the City”) seeking a declaratory judgment that further use of promotional rosters for police sergeant and lieutenant would not violate Section 106 of the Civil Rights Act of 1991 (“the Act”). Dismissal was granted on two grounds: (1) plaintiffs failed to state a claim for deprivation of procedural due process, and (2) plaintiffs failed to allege' a ease of actual controversy cognizable by a federal court.
