It is undoubtedly true that it is necessary, in order to give this court jurisdiction, that the transcript upon appeal should show the organization of the trial court. In the present record it is made to appear that this canse was tried and judgment rendered at the regular term of the circuit court of Morgan county, begun and held at the courthouse thereof on the day fixed by the statute for holding the same, and that the judge who presided was the judge of that circuit.
