Appeal from the Circuit Court of St. Clair. Tried before the Hon. Leroy F. Box. The appellant, William C. Karr, was indicted for the murder of one Jason Smith and was convicted of murder in the second degree, and sentenced to the penitentiary for twelve years. Upon the trial of the case, as is shown by the bill of exceptions, the evidence for the State tended to show that at the time of the shooting, the defendant and his father, John.
