In 1923, Louise Tugman, an infant, suing by her mother as her next friend, instituted this proceeding by motion for a judgment against Riverside and Dan River Cotton Mills, Inc., seeking to recover $75,000 damages for an injury inflicted upon her in April, 1913, through the alleged negligence of the defendants. There was a verdict in her favor for $12,000, which the trial court set aside and entered judgment for the defendant. This action of the trial court is assigned as error.
