Plaintiff was successful in a suit for damages on account of personal injuries. Defendant appeals from the judgment.

In the complaint filed. November 10, 1910. against Southern Pacific Railroad Company, it was alleged that the defendant was “a corporation organized and doing business as a railroad company in the state of California, and under and pursuant to the laws of the state of California.” On that day summons was issued and on November 1, 1911, an alias su >v mons was given in said action.
