AMENDED OPINION

KEITH, Circuit Judge.

Plaintiff appeals a grant of summary judgment which dismissed his action, brought pursuant to 42 U.S.C. § 1983 and the First and Fourteenth Amendments to the U.S. Constitution, on the basis of res judicata. This panel concludes that Plaintiffs suit against Defendants in their individual capacities is not barred by the principles of res judicata. Accordingly, we reverse the district court’s judgment as it relates to the Defendants in their individual capacities.
