This matter involves the noble vegetable asparagus and comes before the Court via two distinct motions. The first is a motion to dismiss certain claims pursuant to Rule 12(b)(6) brought by defendant Super Logistics, LLC (“Super Logistics”) (D.E. 10), which seeks to dispose of counts three, six and seven and argues that they are preempted by federal law.
