On January 12,1922, the parties to this suit entered into a preliminary agreement in writing which resulted in the sale of 279 acres of land located in Washtenaw county, Michigan, by the plaintiff to the defendant. The transaction was consummated by a deed dated February 17, 1922. The plaintiff claims that incident to the negotiations and sale and simultaneously therewith it was orally agreed the plaintiff should assist in making certain improvements on the farm and in consideration thereof he was to have one-half of any profits made by the defendant by a subsequent sale of the property.
