This matter is before the Court on Defendant’s Motion for Summary Judgment (Docs. 38, 39), Plaintiffs’ response in opposition (Docs. 41, 42) and Defendant’s reply thereto (Doc. 43).
I. Complaint
Plaintiffs initiated this litigation on September 29, 2008, alleging discrimination on the basis of race and national origin pursuant to Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq. and the Civil Rights Act of 1866, as amended, 42 U.S.C. § 1981. 1 (Doc. 1).
