OPINION

{¶ 1} Defendant-appellant, Duffy Homes, Inc. ("Duffy Homes"), appeals from a judgment of the Franklin County Court of Common Pleas in favor of plaintiffs-appellees, Gail L. Booth and Calvin L. Booth (collectively, "the Booths"), on the Booths' claim for breach of warranty. The Booths conditionally cross-appeal from the trial court's entry of summary judgment in favor of Duffy Homes on the Booths' claim for violation of the Ohio Consumer Sales Practices Act, R.C. 1345.01, et seq.
