OPINION
{¶ 1} Appellant, Sonny R. Hatfield, appeals from the judgment of conviction in the Ashtabula County Court of Common Pleas on one count of vehicular homicide, a felony of the fourth degree, in violation of R.C.2903.06(A)(3)(a), and one count of aggravated vehicular homicide, a felony of the second degree, in violation of R.C. 2903.06(A)(2)(a). For the reasons discussed herein, we reverse and remand the matter for further proceedings.
