OPINION

PARKS, Judge:

The petitioner, Tommy Douglas Evans, was charged by information on October 23, 1986, with Escape From a Penal Institution, pursuant to 21 O.S.Supp. 1983, § 443(B), in Cleveland County District Court, Case No. CRF-86-1490(T). The Information alleged that Evans unlawfully *681escaped from the John Lilley Correctional Center on January 7, 1985, “while permitted to be at large on an institutional pro-gram_” (Appeal File, A-l).
