For convenience, the parties will be referred to in this opinion as they appeared in the trial court.

Plaintiff’s petition alleged the corporate existence of the defendant, and plaintiff’s appointment as administrator of the estate of Ira Hunter, deceased.

In the charging part of the petition it is alleged, in substance, that the plaintiff and deceased • lived south and west of the defendant’s station at Mohawk, and that north and east of said station there was located the Mohawk public school building, which was attended by the colored children in the vicinity and by adults and children for…
