REED, District Judge.

George W. Whitney, the defendant in error, who will be called the plaintiff, recovered judgment in the Circuit Court against the Union Pacific Railroad Company, which will be called the defendant, for personal injuries to himself, alleged to *786have been caused by the negligence of the Railroad Company, tó reverse which the defendant prosecutes this writ of error.
