This interpleader action was instituted by the Phoenix Mutual Life Insurance Company of Hartford, Connecticut, under the provisions of the Act of January 20, 1936, Ch. 13, Sec. 1, 28 U.S.C.A. § 41, subdivision (26).

The defendant Della Josephine Reich is a citizen and resident of Akron, Ohio. The defendant William P. Reich is a citizen and resident of the Borough of West Bridge-water in the Western District of Pennsylvania.
